Advise
1. Request for Investment Approval from the People’s Committee of Nam Dinh Province
The investor prepares a letter requesting permission to invest in Bao Minh Industrial Park and submits it to the Management Board of Industrial Parks of Nam Dinh Province and Bao Minh Industrial Park Infrastructure Investment Joint Stock Company.
2. Notification of Site Agreement and Issuance of Planning Certificate:
2.1. Number of Documents
– The investor submits 3 sets of documents to the Management Board of Industrial Parks of Nam Dinh Province.
2.2. Documents for Request for Issuance of Planning Certificate
– Application for notification of site and issuance of planning certificate (according to the form in the appendix).
– Land sublease contract signed between the investor and Bao Minh Industrial Park Infrastructure Investment Joint Stock Company, the investor of Bao Minh Industrial Park (notarized copy).
– Business registration certificate of the investor. For foreign investors, a confirmation of legal status from the Vietnamese Embassy in the host country is required.
2.3. Processing Time
– Within 3 working days of receiving all valid documents, the Management Board of Industrial Parks of Nam Dinh Province will notify the investor of the site agreement and issue the planning certificate.
3. Document Preparation Phase:
– Based on the site agreement notification, the planning certificate issued by the Management Board of Industrial Parks of Nam Dinh Province, and other necessary information gathered, the investor or the consulting unit hired by the investor will prepare the following documents:
Economic and technical justification according to current regulations. Note that the economic and technical justification must include preliminary drawings of the factory plan, workshop layout, water supply and drainage system, wastewater treatment system, fire protection system, and electrical system. Prepare an environmental impact assessment report for submission to the Department of Natural Resources and Environment of Nam Dinh Province for appraisal and approval, or prepare an environmental protection commitment registered with the Department of Natural Resources and Environment of Nam Dinh Province. (The list of investment projects requiring environmental impact assessment reports is issued together with Government Decree 80/2006/ND-CP dated August 9, 2006). – During this period, if necessary, investors can contact the Investment Management and Support Board of Bao Minh Industrial Park Infrastructure Investment Joint Stock Company for specific guidance.
4. Registration/Application for Investment Certificate
4.1. Number of Documents
– Investors submit 8 sets of documents to the Management Board of Industrial Parks of Nam Dinh Province, including at least 1 original set.
4.2. Documents for Registration/Application for Investment Certificate
– Application/Application for Investment Certificate (according to the form in the appendix);
– Document confirming the legal status of the investor: establishment decision or business registration certificate (notarized copy);
– Financial capacity report of the investor (prepared and the responsibility of the investor);
– Economic and technical justification;
– Basic design documents of the project;
– Decision approving the economic and technical justification by the investor;
– Site agreement and planning certificate (notarized copy);
– Environmental impact assessment report or environmental protection commitment;
– Results of the environmental impact assessment report or the certificate of registration of the environmental protection commitment issued by the Department of Natural Resources and Environment of Nam Dinh province;
– For investment projects in conditional investment sectors as stipulated in Article 29 of the Investment Law and Appendix III issued with Government Decree No. 108/2006/ND-CP dated September 22, 2006, the investor must submit an explanation of the project’s ability to meet the conditions required by law.
– For investment projects involving the establishment of an economic organization, the investor must submit:
+ Business registration documents corresponding to each type of enterprise as prescribed by the law on enterprises and relevant laws.
+ Joint venture contract for the form of investment involving the establishment of a joint venture economic organization between domestic and foreign investors.
– Other documents as specifically instructed by the Management Board of Industrial Parks of Nam Dinh Province, depending on each case.
4.3. Processing Time
– Within 7 working days from receiving all valid documents, the Management Board of Industrial Parks of Nam Dinh Province will hold a review meeting to issue the Investment Certificate. Based on the review meeting minutes, the Management Board of Industrial Parks of Nam Dinh Province will request the investor to amend or supplement the documents (if any).
– Within 2 working days from receiving the amended and supplemented documents as requested, the Management Board of Industrial Parks of Nam Dinh Province will submit the Investment Certificate to the People’s Committee of Nam Dinh Province for issuance. In case the investment project is not approved, the Management Board of Industrial Parks of Nam Dinh Province will send a written notice to the investor, clearly stating the reasons.
5. On-site land handover
– The Management and Investment Support Board of Bao Minh Industrial Park Infrastructure Investment Joint Stock Company will organize an on-site land handover conference for the investor under the supervision of the Management Board of Industrial Parks of Nam Dinh province and the Land Use Rights Granting Office of the Department of Natural Resources and Environment of Nam Dinh province.
6. Construction permit issuance, fire prevention and control design appraisal and approval
– Based on the dimensions of the leased land area and technical specifications provided by the Management and Investment Support Board of Bao Minh Industrial Park Infrastructure Investment Joint Stock Company, the investor or the consulting unit hired by the investor will proceed with the technical design for the construction of the project’s components and the fire prevention and control design.
6.1. Assessment and Approval of Fire and Explosion Prevention Design
– The investor will work with the Fire Prevention and Rescue Police Department (PC23) of Nam Dinh Provincial Police to assess and approve the fire and explosion prevention design.
6.2. Construction Permit Issuance
6.2.1. Number of Documents
– The investor submits one set of documents to the Management Board of Industrial Parks of Nam Dinh Province.
6.2.2. Documents for Construction Permit Issuance
– Application for a construction permit (according to the form in the appendix);
– Land sublease contract (notarized copy);
– Minutes of land handover at the site (notarized copy);
– Technical construction design drawings including:
+ Overall site plan;
+ Floor plan, elevation, and cross-section drawings;
+ Foundation structure drawings;
+ Drawings of the electrical, water supply, rainwater drainage, and wastewater systems and connection points.
– Investment certificate, business registration certificate of the investor, business registration certificate of the design consulting unit, design appraisal unit, or professional certificate of the individual design consultant or design appraiser (notarized copy);
– Results of the fire and explosion prevention design appraisal and approval by PC23 of the Nam Dinh Provincial Police.
6.2.3. Processing time
– Within 5 working days from the date of receiving all valid documents, the Management Board of Industrial Parks of Nam Dinh Province will issue the construction permit to the investor.
7. Commencement of Construction of Project Items
During construction, if there are any changes to the planning design and the contents of the approved construction permits, the investor must immediately report to the Management Board of Industrial Parks of Nam Dinh Province and Bao Minh Industrial Park Infrastructure Investment Joint Stock Company. The investor is only allowed to continue construction after receiving a decision from the Management Board of Industrial Parks of Nam Dinh Province and Bao Minh Industrial Park Infrastructure Investment Joint Stock Company.
When connecting the rainwater drainage system and the industrial wastewater drainage system to the general system of the entire industrial park, the investor must contact the Management and Investment Support Board of Bao Minh Industrial Park Infrastructure Investment Joint Stock Company for guidance.
8. Issuance of Land Use Right Certificate
8.1. Number of documents: The investor submits 05 sets of original documents to the Land Use Right Issuance Office of the Department of Natural Resources and Environment of Nam Dinh Province.
8.2. Application for Land Use Right Certificate:
- Application for Investment Certificate (according to the form in the appendix).
- Declaration dossier for application for Land Use Right Certificate (according to the form in the appendix).
- Economic and technical explanation of the Investor.
- On-site land handover minutes.
- Notarized copy of the land sublease contract certified by the Management Board of Industrial Parks of Nam Dinh province.
- Notarized copy of the Investment Certificate.
- Notarized copy of the decision approving the environmental impact assessment report of the Department of Natural Resources and Environment of Nam Dinh province or the Investor’s environmental protection commitment.
- Notarized copy of the fire safety assessment results of PC23, Nam Dinh Provincial Police.
- Notarized copy of the overall project planning drawing certified by the Management Board of Industrial Parks of Nam Dinh province.
8.3. Processing time:
– 45 days after the Land Use Rights Granting Office receives the complete dossier.
9. Completion of basic construction and putting the project into operation.
Throughout the entire process of project preparation and the commencement of production and business activities of enterprises in Bao Minh Industrial Park, the Management and Investment Support Board of Bao Minh Industrial Park Infrastructure Investment Joint Stock Company is the focal point for guiding, assisting, resolving, or coordinating with relevant departments and authorities of Nam Dinh province as well as the central government to resolve obstacles and difficulties of investors.
